As you may already know, Title VII of the Civil Rights Act mandates that employers with a workforce of 15 or more must provide reasonable accommodations for their employees' religious practices and beliefs, unless it results in an undue hardship.
The Supreme Court has recently redefined undue hardship, as it pertains to religious accommodations, to mean "a substantial increased cost in relation to the conduct of [the employer's] particular business." The term 'substantial' is not explicitly defined, but the Court suggests that employers should evaluate the requested accommodation and its practical impact relative to their business's nature, size, and operating costs. It's important to note that even under the previous de minimis standard, the EEOC indicated in federal regulations that undue hardship was unlikely to be caused by temporary costs, voluntary or occasional shift swapping, or administrative costs.
This new interpretation implies that it will be more challenging for employers to refuse religious accommodations based on the grounds of undue hardship. Therefore, it is advisable for employers to accommodate most requests unless they can definitively demonstrate substantially increased costs.
